1. Eligibility

This website is not intended for use by minors, and you represent and warrant that you are at least 18 years of age before using the Service; you have not been previously banned or suspended from using our services; you have the authority to enter into this agreement and not violate any other agreements to which you are a party; and you are neither a citizen nor a resident of any prohibited territory.

If you are engaging into this agreement on behalf of a legal entity, you represent and warrant that you have all the necessary rights and authority to act on its behalf.

2. Prohibited Countries and Territories

2.1 Currently, DOSH TRUST only serves European residents, although a few countries and regions are prohibited.

DOSH TRUST does not provide service to the countries and regions listed below. This listing is subject to alteration: Albania, Barbados, Bahamas, Belarus, Benin, Bolivia, Bosnia-Herzegovina, Botswana, Burkina Faso, Cambodia, Cameroon, Cayman Islands, Central African Republic, Chad, China, Congo, Crimea, Cuba, Democratic Republic of the Congo, Democratic People's Republic of Korea, Ecuador, Ethiopia, Gibraltar, Haiti, Iran, Islamic Republic of Afghanistan, Jordan, Jamaica, Lebanon, Libya, Mali, Morocco, Mozambique, Myanmar, Nepal, Nicaragua, Philippines, Panama, Russia, Senegal, South Sudan, State of Palestine, Sudan, Syria, Tanzania, Trinidad and Tobago, Uganda, Venezuela, Yemen, Zambia, Zimbabwe, Pridnestrovian Moldavian Republic, Turkey, United States of America

2.2 Sanctions

Sanctions are restrictive measures imposed by international public law and endorsed by international organisations and/or states against nations, specific subjects of sanctions (terrorists, persons accused of military and political crime, extremist organizations, etc.), or activities.

The business adheres rigorously to national and international sanctions. DOSH TRUST ensures that its services and client exchanges comply with the requirements outlined in the laws and regulations of the Republic of Poland and the European Union, as well as with sanctions implemented by the European Union and the United Nations.

Before beginning cooperation and/or making a payment, the company strongly advises verifying information on sanctions and alterations in this area.

3. Payments

3.1 Please note that payments from or to bank accounts or accounts in payment systems belonging to THIRD PARTIES are strictly prohibited. To process a payment, the account name must match the name specified in your profile in the DOSH TRUST system to process a payment.

4. Services and verification 

4.1 Services

DOSH TRUST offers a platform for the purchase and sale of virtual currencies, primarily Tether (USDT).

Please keep in mind that virtual currencies are decentralized and as such are not regulated.

Before using the Service, all Customers must be verified with our verification partner "SUMSUB." To utilize our service, you must complete verification and agree to our Terms and Conditions, AML Policy, and Privacy Policy.

Having read and accepted these Terms and Conditions, the client confirms that all information has been submitted and all required documents have been uploaded independently and without third-party assistance.

DOSH TRUST may, at its sole discretion, decline to provide you with services. You agree to provide complete and accurate information and to update any information you provide to DOSH TRUST so that it is always accurate and complete. DOSH TRUST reserves the right to decline to perform a service at our sole discretion. If you provide false information, your use of or access to the website may be terminated.   

4.2 Verification

You agree to provide the requested personal information for the objectives of identity verification. This information is requested and used to prevent money laundering and terrorism financing, fraud, and other financial crimes, as well as to enable us to maintain a record of this information. Before you are permitted to use the service, you will need to complete a series of verification steps. The personal information we request may include, but is not limited to, your name, address, telephone number, email address, evidence of address, and information regarding your bank account (such as the bank's name and sort code). By providing us with this or any other information that may be required, you attest that it is accurate and genuine. You agree to keep us informed of any changes to the information you provide.

You grant us permission to make any inquiries we deem necessary to verify your identity or protect you and/or us from fraud or other financial crimes, and to take any actions we deem reasonable based on the results of such inquiries. When we conduct these inquiries, you acknowledge and agree that your personal information may be disclosed upon official request to credit or payment institutions and law enforcement. Individually, we may request enhanced due diligence, even if the total value of your transactions does not exceed the account's limit.

To finalize your personal identity verification, you must upload the following documents to the verification page:

1) a personal data questionnaire; 
2) a copy of your valid passport, ID, or driver's license;
3) a liveness check using a video camera;
4) a document proving your address;
5) a questionnaire.

We outline our rights and the User's responsibilities regarding the provision of reasonably verifiable information to ensure the user's legitimacy and DOSH TRUST's commitments to uphold its regulatory obligations in knowing its customers (KYC) and understanding their DOSH TRUST transactions (KYT).

5. Processing of transactions and refunds

5.1 We endeavor to complete all transactions within four business days. If you haven't received your virtual currencies within four business days, you can still rescind the transaction and receive a full refund. Refunds are typically processed within 24 hours using the same payment method used for the initial transaction.

5.2 Please be advised that in order to finalize a transaction, DOSH TRUST may request additional information or documentation, which must be provided within 24 hours of receiving the request. On average, documents provided upon request are evaluated within 24 hours of their submission.

If the documents do not satisfy the request's requirements, you will receive an additional request; therefore, we may require additional time for review. In some instances (such as when there are a large number of documents under review, a large number of transactions, or other circumstances necessitating a more in-depth analysis), the review may take longer.

5.3 Please be advised that DOSH TRUST Sp. z o.o. is not a payment service provider (PSP) and does not own a financial license. Therefore, it is prohibited to store customer funds in our service.

6. Taxation

6.1 The User agrees to pay all taxes and duties deriving from his/her use of DOSH TRUST Services, which must be paid in accordance with the laws of the User's jurisdiction of residence.

6.2. DOSH TRUST is not liable for any violations committed by the user as a result of his/her responsibility to calculate and pay taxes and duties.

7. Financial or legal advice

7.1 DOSH TRUST does not offer financial, investment, or legal advice in relation to the Services it provides. DOSH TRUST may provide information on the price, range, and factors that have affected the price of Cryptocurrencies, but this should not be construed as investment or financial advice. Any decision to acquire or sell Cryptocurrencies is the responsibility of the User, and DOSH TRUST is not liable for any resulting loss. Users should undertake their own Cryptocurrency-related research.

8. Limitation of loss

The exchange service DOSH TRUST offers only exchange services and does not offer cryptocurrency storage (wallet creation) or brokerage services to its customers. Under no circumstances shall we be liable for any of the following categories of loss or damage arising out of or in connection with these terms or otherwise:

• Any loss of profits or anticipated revenue or gains, including any loss of anticipated trading profits and/or actual or hypothetical trading losses.

• Any loss or injury to reputation or goodwill; any loss of business or opportunity, customers or contracts; any loss or waste of overheads, management or staff time; and any other loss of revenue or actual or anticipated savings.

• Any loss of use of hardware, software, or data and/or any corruption of data; including, but not limited to, any losses or damages arising out of or relating to any inaccuracy, defect, or omission of digital currency price data; any error or delay in the transmission of such data; and/or any interruption in the transmission of such data.

• Any loss or damage whatsoever that is not directly caused by our breach of these Terms; and/or any loss or damage whatsoever that exceeds that which was directly caused by our breach of these Terms (regardless of whether you can prove such loss or damage).

• Any loss resulting from circumstances beyond our control, such as conflict or the threat of war, a change in political regime, or other actions by third parties.

9. Assumption of risk

Cryptocurrency entails substantial risks.

• You accept and acknowledge the risks associated with the use of cryptocurrency wallets, including the risk of equipment failure; the risk of software malfunction; disruption of internet access; the risk of malware manipulation; and the risk of unauthorized access to information stored in your cryptocurrency wallet by third parties.

• DOSH TRUST is not liable for any communication failures, errors, or delays that you might encounter. 

• We are not liable for any losses, damages, or claims resulting from the use of compromised wallets, incorrectly entered wallet addresses, viruses, or third-party attacks.

•  You assume complete responsibility for your wallet or account while using the service. Remember that you are responsible for safeguarding your wallet against unauthorized access and securing your private keys.

• In the event of a return, all electronic money transfer commission fees are deducted from the funds received from the Customer.

•  DOSH TRUST transfers a specified quantity of virtual currency/fiat funds at the exchange rate in effect at the time of order placement.

• DOSH TRUST has the right to halt the sale of electronic currencies if the user fails to provide the required identification documents or other documentation.

10. External systems

The End User shall consent to the following provisions:

• DOSH TRUST uses a third party service and such third party's affiliate services to enable you to make monetary deposits and perform transfer of payments within Partners' website by using your existing credit card (as and when available and applicable) (the "Service" and the "Third Party Service Provider"). The Services do not include any additional services, and third-party services do not include providing and/or depositing Cryptocurrency to your account.

• DOSH TRUST may share and transfer (including cross-border transfer) Personal Information to the Third Party Service Provider for the purpose of providing the Services that will be rendered to the Partners' website. The Personal Information will be shared with the Third Party Service Provider once you choose to execute such monetary transactions. For the purposes of this section, "Personal Information" refers to information that identifies or may identify you, including the information you submit through the verification, such as your e-mail address, country, and city, and/or information provided through social websites, as well as any other identifying information you provide while using our services.

• Additionally, we may transfer any Non-Personal Information provided by you through your use of the services to the Third Party Service Provider in order to allow the Third Party Service Provider to perform preliminary examinations of Non-Personal Information for the purpose of determining whether you are qualified to use the services of such Third Party Service Provider (including the history of your transactions, which will be provided without any identifying information).

• By agreeing to these terms, you affirm that any and all information you provide is true and accurate. Any use of deceptive or fraudulent information and/or services is strictly prohibited.

• You are not required by law to disclose any Personal Information to Partner and/or the Third Party Service Provider. You hereby acknowledge and agree that you are voluntarily providing Personal Information to Partner and/or the Third Party Service Provider for the purposes of rendering the Services.

11. Links to external domains

11.1 This Site and its Services may contain links to websites not owned or controlled by DOSH TRUST. DOSH TRUST disclaims all liability for the content, terms and conditions, privacy policies, and practices of any third-party websites.

In addition, DOSH TRUST neither censors nor modifies the content of third-party websites. By using this Site or its Services, you expressly release DOSH TRUST from any and all liability deriving from the User's use of any third-party website.

Therefore, DOSH TRUST encourages you to be aware when you depart this Site or the services found on this site and to review the terms and conditions, privacy policies, and other governing documents of each website you visit.

12. Transfer of Control

12.1. If DOSH TRUST is acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control. Please refer to DOSH TRUST's privacy policy for more details.

13. Changes in terms

DOSH TRUST reserves the right to modify these terms and conditions without prior notice and at any time. Immediately after any modifications are made, the revised terms and conditions will be posted on this website, and you will be notified. Please review the most recent information posted on this page for any updates.

14. Dispute resolution

If You are dissatisfied with our services in accordance with these Terms and Conditions, You may file a written complaint with us at contact@doshtrust.com. We will make every effort to address your complaint at the earliest opportunity, and we will send you a final response letter within a month of receiving it. If you do not receive your final response or if you are dissatisfied with our final response, you have the option to enforce your rights before the Polish courts with jurisdiction over the matter.

All disputes arising out of or relating in any way to these Terms or the relationship between the service and the customer will be settled through negotiation between the parties involved.

The laws of the Polish Republic regulate every aspect of business.
